Welcome to APBT-BSL.COM
The sole purpose of this website is to encourage people to open their eyes, to get past limiting paradigms and to think for themselves. No human being has all the truth - we all "see through the glass darkly" as the apostle Paul wrote. Too many of us stubbornly cling to our cherished beliefs even when we suspect there is something wrong with them and they may need modification. Sometimes reality does not correspond to what we believe and we experience "cognitive dissonance". We become close minded about our beliefs and are afraid to examine them. Running from our doubts never works - better to face our doubts and resolve them.
BSL stands for Breed Specific legislation. It is when a law
is passed in a town that has to do with specific breeds of dogs, a favorite
subject being rottweilers or Pit Bulls. These legislations are passed because
people are afraid, but rather than punishing a person who owns one of these
dogs and does not train them, it punishes the dogs, many of which are well adjusted
pets. The legislation is often that anyone owning a "insert dog breed here" must have them spayed/neutered, restrained, normally with
a muzzle at all times, and needs to take out a hefty insurance policy on the
dog.
That is the tame version of the law. Another version demands
that all dogs of the chosen breed be destroyed if in a humane society, and moved
if they live in a private home, as they are no longer allowed within city limits.
Both of these laws punish the dogs and good owners of the dog, while the people
who bred or trained the dog are free to get a dog of one of the non restricted
breeds and start over again. The reason that rottweillers and pit bulls are
often targeted is that they are common and get news coverage. They are also
breeds not to be taken lightly. |

25 on a proposed ordinance to ban the tethering of dogs.
For more than two years, animal advocates and the county have
discussed implementing such a law, based on the premise that chaining
or otherwise tethering animals outside is cruel and inhumane and that
the practice contributes to constant barking and even causes dogs to
become overly aggressive.
At a work session Monday, commissioners scheduled the public hearing
for the end of the month, to be held in the commissioners' chambers at
200 E. Main St. A draft of the ordinance prepared by the county's
Animal Control Advisory Committee will be available for public comment.
If necessary, commissioners could hold a second public hearing in
September, just before the board votes on the final proposed ordinance.
If commissioners approve the new law, it would go into effect after a
15-month education campaign by the county. The ordinance would be
enforced by the county's animal control department in the entire
county, including inside the Durham city limits.

Iredell County has drafted changes to its ordinance which will include
definitions and standards for commercial and non-commercial kennels. The
excessive commercial standards would require owners of 20 or more animals to have
expensive buildings, impervious surfaces for cleaning, temperature control, and
restrooms for staff and more. However, these conditions as set are a mute
point since the proposed ordinances revision also includes the requirement for
commercial kennels to have licensing from North Carolina Department of
Agriculture (NCDA). The owner of 20 animals for personal use and/or selling retail
is NOT covered by existing NCDA regulations. Therefore, no license can be
obtained and owning 20 or more animals would be illegal in Iredell County. In
short, the proposed ordinance is a LIMIT LAW for Iredell County where the
maximum number of owned animals of one species would be 19.
*Kennels - Commercial means any person maintaining an establishment where
animals of any species, excluding domesticated livestock, kept for the purpose
of breeding, buying, selling or boarding such animals or engaged in the
training of dogs for guard or sentry purposes, and which establishment is so
constructed that the animals cannot stray from the establishment; or any person
owning or keeping twenty (20) or more animals, excluding domesticated
livestock, each of which is four months of age or older. Kennel owners must have
proper licensing from the North Carolina Department of Agriculture.
Kennels - Noncommercial means any person maintaining an establishment where
animals of any species, excluding domesticated livestock, are kept for the
purpose of showing, competition, hunting or sport, and which establishment is
so constructed that the animals cannot stray from the establishment, and which
maintains no more than nineteen (19) animals.*
Standards for Commercial Kennels
All commercial kennels located within Iredell County shall, in addition to
the other requirements of this article, comply with the minimum standards of
this article. Facilities shall be subject to inspection during reasonable
hours by an animal control officer upon his request. The animal control officer
may be accompanied by a county appointed cruelty investigator upon the animal
control officer's request. Failure to meet the standards set out in this
section shall be grounds for the issuance of a citation subjecting the owner to
the penalties described in this article, and/or the issuance of an abatement
order to comply with the provisions of this article. The premises of
commercial kennels shall meet the following standards:
(1) Buildings or enclosures must be provided, which shall allow adequate
protection against extreme weather conditions. Floors of buildings and runs, and
walls shall be of a nonporous material or otherwise constructed as to permit
proper cleaning and disinfecting. Temperatures in animal containments shall
be maintained at a level that is healthful for every species of animal in the
containment.
(2) Cages, kennels or runs shall have sufficient space for each animal to
sit, stand up, lie down, turn around and stretch out to its full length without
touching the sides or tops of the cage, kennel or run. Cages, kennels and
runs are to be of a material and construction that permits cleaning and
disinfecting, and shall have an impervious surface. Cage, kennel and run floors of
concrete shall have a resting board or some type of bedding. Cages, kennels
and runs shall provide protection from the weather. All animal quarters are to
be kept clean, dry and in a sanitary condition. Cages, kennels and runs shall
be structurally sound and maintained in good repair to protect animals from
potential injury, contain the animals, and restrict the entrance of other
animals and people.
(3) Animals shall not be placed in cages, kennels or runs unless such cages,
kennels or runs are so constructed to prevent animal excretions from
entering other cages, kennels or runs.
(4) Sufficient shade shall be provided to allow all animals kept outdoors to
protect themselves from the direct rays of the sun.
(5) Each animal shall be given the opportunity for daily exercise as
appropriate.
(6) Litter boxes shall be provided for cats and kittens.
(7) Food shall not be contaminated and shall be wholesome, palatable, and of
sufficient quantity and nutritive value and offered at appropriate intervals
to meet the normal daily requirements for the condition, size and age of the
animal. Food for all animals shall be served in a clean container so mounted
that the animals cannot readily tip it over or defecate or urinate in it.
(8) Supplies of food and bedding shall be stored in facilities that
adequately protect such supplies against infestation or contamination by vermin.
Refrigeration shall be provided for supplies of perishable food.
(9) All animals shall have fresh, drinkable water available at all times.
Water containers shall be of a removable type and be mounted or secured so that
the animals cannot readily tip them over or defecate or urinate in them.
(10) All food and water containers shall be cleaned and disinfected daily.
(11) All animals must be fed and watered, and all cages and kennels cleaned
each day, including Sundays and holidays.
(12) Medical care shall be provided as needed for each animal by a
veterinarian licensed to practice in the State of North Carolina.
(13) Provisions shall be made for the removal and disposal of animal and
food waste, bedding and debris.
(14) Facilities such as a washroom, sink or basin shall be provided to
maintain cleanliness among animal caretakers and animal food and water containers.
(15) Facilities for animals shall be adequately ventilated to provide for
the health and comfort of the animals at all times. Such facilities shall be
provided with fresh air, either by means of windows, doors, vents or air
conditioning, and shall be ventilated so as to minimize drafts, odors and moisture
condensation.
(16) Facilities for animals shall have ample light by natural or artificial
means or both, of good quality and well distributed and as appropriate for
each animal's health and well-being. Such lighting shall provide uniformly
distributed illumination of sufficient light intensity to permit routine
inspection and cleaning during the entire working period. Enclosures shall be so
placed as to protect the animals from excessive illumination.
(17) Every person maintaining such a facility shall post a notice clearly
visible from the ground level at the main entrance to the facility containing
the names, addresses and telephone numbers of persons responsible for the
facility where they may be contacted during any hour of the day or night.
Additionally an animal deemed a public nuisance is required to be
spay/neutered within 45 days. Animal Control officers are solely responsible for this
determination and there is no appeal process.
*Upon determining that an animal is a public nuisance, the animal control
officer shall make a good faith attempt to notify the owner in writing of such
determination, and also make a good faith attempt to obtain the owner’s
written acknowledgement of such determination. However, such acknowledgement shall
not constitute a necessary element for a violation by the owner of this
section.
The determination by an animal control officer that an animal is a public
nuisance shall be final.
The owner shall submit proof of spay/neuter within forty-five days (45) as
required by Section 3-20 of this ordinance. *
Iredell County has requested formal, written letters of opposition.
Letters must be received no later than Noon, July 9th, 2008. A public hearing is
proposed for the last Board of Commissioner's Meeting in August (the 19th).

Hillsborough, N.C. - Orange County commissioners heard long and loud Tuesday
night from advocates pushing for a new ordinance to limit dog tethering and
from opponents, and the controversy delayed any decisions.
The board finally ended the public hearing without a vote, likely deferring
action until fall.
The hearing went late into the night as the two sides sparred over the
issue.
"Tiger before was a broken dog. His spirit was broken," said Heather Brown,
with the Coalition to Unchain Dogs.
Tiger used to be chained to a 4-foot tether day and night, Brown said. The
Coalition to Unchain Dogs has since built Tiger a fence.
"His tail never stops. He's happy. He gets to run," Brown said of Tiger's
transformation.
"I am very opposed," George Painter, president of the Eno River Coon Hunters
Association, said of the amendment. "For one thing, it's an injustice."
The coalition wants Orange County to severely restrict the dog-tethering
portion of its animal control ordinance to allow no more than three hours in a
24-hour period.
The amendment drawn up county staff also would specify types of collars and
equipment that could be used, minimum kennel sizes, certain exemptions and an
18-month educational period after enactment.
As presented Tuesday night, the ordinance would take effect in June 2009 and
would have violators issued only warnings for one year as an educational
effort. Penalties would not start until 2010.
The board had ordered the amendment drawn up last November after getting the
report of a tethering committee.
Officials said Wednesday that a packed agenda for the commissioners' last
spring meeting and the standard summer recess meant the ordinance won't come up
again before September at the earliest.
Suzanne Roy said chains pose a safety hazard to dogs and that the coalition
offers to build fences for dog owners who need financial assistance.
"Oh yes, we'd be very happy to build a fence around my 12-acre property,"
Painter said sarcastically of the offer.
"Well, dogs don't run on 10 acres, they're on 10-foot tethers. I mean they
don't have to fence the entire property," Roy responded.

Pennsylvania House Bill 2553 Sunday, June 01 @ 04:23:04 PDT by blackheart (69 reads) | Pennsylvania House Bill 2553 will remove the state's prohibition on breed specific local ordinances, thereby allowing municipalities to adopt any type of law applicable to dangerous dogs, including breed-specific ordinances. It is imperative that concerned dog owners in Pennsylvania contact their legislators and express their strong opposition to this bill.
The American Kennel Club supports reasonable, enforceable, non-discriminatory laws to govern the ownership of dogs. The AKC believes that dog owners should be responsible for their dogs. We support laws that: establish a fair process by which specific dogs are identified as "dangerous" based on stated, measurable actions; impose appropriate penalties on irresponsible owners; and establish a well-defined method for dealing with dogs proven to be dangerous. The American Kennel Club strongly opposes any legislation that determines a dog to be "dangerous" based on specific breeds or phenotypic classes of dogs.
By allowing municipalities to impose breed-specific dangerous dog ordinances, HB 2553, if passed, will permit communities to unfairly target well-behaved dogs of specific breeds, thereby raising the possibility of harsh care and condition requirements or the possibility of penalties for owning certain breeds while not focusing on whether or not an individual dog has previously exhibited dangerous behavior. Additionally, the breed-specific ordinances allowed under this bill will create an unenforceable patchwork of dangerous dog rules across the Commonwealth.
WHAT YOU CAN DO:
Concerned Pennsylvania dog owners should contact the members of the House Agriculture and Rural Affairs Committee. Respectfully let them know that HB 2553 is an unacceptable means to address dog control issues.

Representative Tyrone Yates has proposed a bill today that would prohibit the ownership of “pit bulls” in the state of Ohio. The bill requires all owners to surrender their "pit bulls" within 90 days of the effective date of the proposed law. The bill is unequivocal that the dog warden "shall" euthanize all “pit bulls” within 10 days of their surrender.
Also under this proposal a dog warden or other officer that has probable cause to believe that a dog is a “pit bull” dog, may apply for a search warrant. With the search warrant the officer will have the authority to seize the “pit bull” dog and surrender it to the dog
warden to be killed."
They want to kill thousands of dogs for no reason other than being a certain look!! What is wrong with this world???!!!!

Sec. 955.111. (A) Beginning ninety days after the effective date of this section, no person shall own, keep, or harbor a dog that belongs to a breed that is commonly known as a pit bull dog.
(B) Not later than ninety days after the effective date of this section, a person who owns, keeps, or harbors a pit bull dog on the effective date of this section shall surrender the dog to the dog warden. Not later than ten days after receiving the dog, the dog warden shall euthanize the dog.
(C)(1) Beginning ninety days after the effective date of this section, if an officer has probable cause to believe that a dog is a pit bull dog, the officer may apply to a court of competent jurisdiction for a search warrant. The court shall issue a search warrant for the purposes requested if there is probable cause to believe that a dog is a pit bull dog.
(2) After obtaining a search warrant, an officer shall seize the pit bull dog and surrender the dog to the dog warden. Not later than ten days after receiving the dog, the dog warden shall euthanize the dog.
(D) As used in this section, "officer" has the same meaning as in section 959.132 of the Revised Code.
Section 2. That existing section 955.11 of the Revised Code is hereby repealed.

Ohio to Ban ALL pitbulls HB 568 -Might
affect boxers, labs, bulldogs, etc. etc.
Do you think such a ban won't affect you because you don't have a pitbull? All it would take is for some dummy to think a lab looks like a pit or etc. And then next on the
list will be the rotties...Furthermore, another personal right to our homes and
property is being endangered.
Cincinnati they are also trying to ban pits. Our representatives won't put pressure on officials to prosecute the law nor on the wrong-doers because it is so much easier to go after all of the peace-loving, lawful dog owners.
Please ask everyone you know to protest - on behalf of the many wonderful ‘pitbulls‘ in the world, for the many pitbulls and other dogs who have suffered and died due to human greed and inhumanity, for the many other dogs who will die if this passes and for the loss of our personal freedoms – this bill does not even provide a process for appeal in time to keep dogs from being seized and killed in 10 days!

This is over the edge, what happen to our freedom???? They can come in your house if they even think you have a pit bull. Most people don't even know what a pitbull looks like (don't piss off your neighbor or all of a sudden your boxer x is now a pit bull x), all different breeds will be targeted as pits or pit bull type dogs. Please make the call’s and send letters and be polite. We need to let them know how strongly we oppose this ordinance.
The ADBA, AKC and UKC believes that strong enforcement of leash laws, as well as clear guidelines for identifying and managing dangerous dogs, will promote responsible dog ownership and prevent tragedies from occurring. Simply placing restrictions on certain breeds will not improve public safety - it will only punish responsible dog owners.
We strongly support sound, enforceable, non-discriminatory legislation to govern dog ownership, and we appreciate legislators' desire to keep communities safe for both people and dogs. However, BSL will not address the root cause of dangerous dogs – irresponsible ownership!
Points to Address:
• BSL is inflammatory, and is based upon unproven beliefs, not facts.
• BSL is under inclusive in that it only recognizes a threat to society from certain breeds, or mixed breeds of dogs.
• BSL is over inclusive, as dogs are as varied within their breed, as are human beings within our ethnicity.
• BSL by stipulating, and naming specific breeds as being dangerous indemnifies all of the unnamed breeds as being safe by exclusion.
• BSL creates a false sense of public safety.
• BSL does not address the irresponsible dog owner.
• BSL punishes the law abiding dog owner.
• BSL orders the death of dogs based solely upon their physical appearance.
• BSL assumes that human beings are inferior to, and incapable of properly maintaining dogs of specific breeds, or appearance.
Breed-specific legislation is opposed by the ADBA, AKC, UKC, EBA, the American Veterinary Medical Association, the National Animal Control Association, the ASPCA, and a host of national animal welfare organizations that have studied the issue and recognize that targeting breeds simply does not work.
BSL CASE LAW
• BSL has been ruled unconstitutional in Court venues across the United States on grounds ranging from vagueness, to an infringement of property rights, to equal treatment, equal protection.
• Dogs have been the domesticated traditional property of human beings for well over thirty-five thousand years. This tradition gives legal standing to dog owners based upon the IX Amendment of the Bill of Rights in the Constitution of the United States of America.
• BSL violates the rights granted under the IV Amendment to the Bill of Rights.
• BSL violates the rights granted under the V Amendment of the Bill of Rights.
• BSL violates the rights granted under VI Amendment to the Bill of Rights.
• BSL violates the rights granted under VIII Amendment to the Bill of Rights.
• BSL violates the rights granted under XIV Amendment to the Bill of Rights.
• BSL creates a whole new criminal class, the dog owner
• BSL sets a legal precedent that unchallenged empowers the enacting body to add any, or all other dog breeds, or even domestic species of animals to the prohibition on ownership.
Zuniga v. San Mateo Dept. of Health Services (1990) 218 Cal. App. 3d 1521, 267 Cal. Rptr. 2d 755. The court found there was not sufficient evidence to prove Pit Bulls have an inherent nature of being dangerous.
Carter v. Metro North Assocs. (1998) 255 A.D. 2d 251; 680 N.Y.S.2d 299 A New York appellate court determined that the alleged propensities of Pit Bull Terriers to behave more viciously than other breeds had not been authoritatively established.
American Canine Foundation litigated the city of Huntsville Alabama in 2002 in a case that was heard by the Alabama Supreme Court. Huntsville v. Shelia Tact, et al.
(Ala. 08-30-02), No.1010459, unreported. The court affirmed a trial court decision that American Pit Bull Terriers were not dangerous.
On July 16th 2003 ACF brought forth a constitutional challenge against Ohio's state law O.R.C. 955:11 that declares the Pit Bull vicious. The case was heard in the Toledo Municipal Court. The court found the American Pit Bull Terrier was not dangerous, and granted Pit Bull owners due process. Tellings v State of Ohio CRB02-15267
In August 2004 a case American Canine Foundation assisted in was heard by the Ohio Supreme Court. State v. Cowan 103 Ohio St. 3d 144 , 2004 - Ohio - 4777 The court found ORC 955:22 volatile of the right to be heard as applied to ORC955:11 which declared a specific breed of dog vicious in Ohio. The decision struck down Ohio's breed specific legislation at the state level. Ohio was the only state to have this type of legislation at the state level.
RULE OF REASON
• Laws must be reasonable.
• It is not reasonable to write animal behaviors, legal punishments, and criminal labels for animals into statutes that are enacted to structure human society.
• Animals must not be criminalized under laws that are intended to protect human rights, and to control human behaviors.
• It is unreasonable to write animal behavior into laws that no animal has the capacity to understand, answer to, or to function under.
• It is unreasonable to mete out criminal labels to animals, i.e. dangerous, or potentially dangerous. It is unreasonable to proscribe punishments to animals under our laws.
• It is unreasonable to remove the human owner from blame, or culpability for the actions of his/her animal(s).
• It is unreasonable to assume that every dog of a given breed, or physical appearance will behave in exactly the same manner.
• It is unreasonable to assume that every owner of every dog of a given breed, or physical appearance is irresponsible, negligent, or careless with their animal(s).
• Human error, carelessness, or negligence is the underlying factor behind every dog attack.
• Given the actual figures of severe dog attacks, or fatalities related to dog attacks per capita in the United States of America, dogs are not the threat to human life that the sensationalistic media, and urban myth would portray.
There exists at this time no scientific proof that a breed of dog is dangerous. Conclusions based on accurate fatal dog attacks combined with dog bite incident reports prove a dogs breed is not a factor in aggressive behavior. Breed bans do nothing to stop dog attacks, they do nothing to stop illegal activity, they do nothing to protect the public from irresponsible dog owners and punish responsible dog owners, causing court litigation, wasted tax money and impoundment of innocent dogs while criminalizing U.S. Citizens.
Problems stem from inadequate budget or man power to enforce the laws, inadequate training to effectively deal with the problem dogs in a humane way, and low priority of animal control issues. Poor community education of existing animal control laws and lack of judicial support in upholding effective penalties also create serious problems. Strong laws that penalize the owners, regardless of the breed are what is needed. These types of laws are valid, have merit, are not vague or capricious. We ALL support laws that hold owners accountable for their dog’s behavior.
Non-breed specific laws are valid under the Constitution, and are for the protection of the public welfare and safety with the degree of precision that characterizes effective legislation.
BSL and the Cost to Taxpayers
1. Cost of additional animal control officers to enforce the ban or restrictions. **Remember, most cities do not have sufficient animal control departments to enforce leash laws, which if enforced would reduce many of the problems that lead to bite incidents.
2. Kenneling.
3. Veterinary care of the animals. (Hope you don't think the animals are confiscated and immediately euthanized).
4. Legal fees, court costs, etc., associated with responsible owners lawsuits against ineffective and unconstitutional laws.
5. Baltimore, Maryland estimated (in 2001) that it cost over $750,000 a year to enforce their breed specific legislation, and they were still unable to enforce the law effectively.
6. Prince George County, Maryland reviewed their existing dangerous dog laws, including a ban on pit bulls. The task force recommended repealing the law and sited these cost factors:
(a) Loss of revenue - since the ban has been in effect, there has been a dramatic reduction in dog show/exhibits in the county. Along with this comes some indirect loss of revenue such as hotel/motels, restaurants, gas stations, veterinarians, pet supply stores, grocery and drug stores, etc.
(b) Director of Animal Management Division estimated the County's cost for maintaining a single pit bull throughout the entire process for one (1) year was $68,000.
(c) Fees from pit bull registration in 2001-2002 generated approximately $35,000 over the two (2) year period. However, the cost to the Animal Management Division for maintenance of pit bulls over the same period was $560,000. In addition, these figures would be higher but did not take into consideration utilities, manpower and overtime.
(d) It should be noted that these average costs to Prince George County do not include the expenditures of the of the County or Municipal police departments. These cross-agency costs, while significant, could not be fully captured or adequately estimated.

Today we had a walk for them at the Petsmart on 24. There were 18 dogs total, it was amazing! Because of the wonderful turnout we will now being doing it every Saturday. We need support! Bring dogs and educate people."

Dillon City Council approved an ordinance that defines the pit-bull as a
dangerous animal, and gives owners stricter guidelines.
The council´s decision was unanimous, but not everyone in the city of Dillon
is in agreement.
You won´t catch Jodi Hardwick at the city council meeting speaking out for
pit-bulls, but for her family Bootsie May is truly man´s best friend.
"She´ll lick them, play with them. She´s wonderful with the children. She
sleeps with them at night," said Jodi Hardwick, owns a pit-bull in Dillon.
For Councilman Randolph Gurley it´s a breed that´s just too dangerous.
"I´ve seen too many people breeding these dogs and for many people walking
these dogs and too many incidents that´s happening with these dogs," said
Councilman Gurley.
Hardwick herself admits pit-bulls aren´t the most popular.
"This is not the type of dog that I would ever thought I would have had
around my children, but once we got her my view on them has completely changed,"
said Hardwick.
But, she also said people are too quick to judge.
"They´re not all mean dogs if you get a good one," said Hardwick.
"We´re not talking about how nice the dog could be or what kind of good
animal he is, these dogs will turn on you," said Gurley.
Good or bad, Dillon residents now have stricter guidelines for owning a
pit-bull.
Pit-bull owners must register their dog with Dillon Police.
If the dog is walked within the city limits it must be on a four to five
foot leash.
A fence is also required and any owner that violates the new ordinance could
face fines, legal charges up to a misfeasor and the dog could even be put to
sleep.
This ordinance also includes dogs that look like bull terriers, or American
Staffordshire Terriers
